The Department of the Environment and Local Government has overall responsibility for the implementation of Directives 90/219/EEC on the contained use of genetically modified micro-organisms and 90/220/EEC on the deliberate release of genetically modified organisms to the environment.
The Agency is a statutory independent body and the Minister for the Environment and Local Government has no function in relation to the determination of field trial notifications under Part B of Directive 90/220/EEC or competent authority decisions under Article 13. Member State functions under Article 21 of the Directive are fulfilled by the Minister.
The 1994 Regulations provide for an Advisory Committee on Genetically Modified Organisms to advise the EPA on any aspect of its statutory functions in this area. The Advisory Committee is appointed by the Agency.
The Department of Health and Children is currently the agency with responsibility for Novel Foods. Scientific advice on the safety of these foods is sought from the GMO and Novel Foods Sub-committee of the Food Safety Authority of Ireland.
